Terms of Service

These terms govern contractor accounts, residential and commercial emergency-repair advertising campaigns, campaign funding, call tracking and delivery, payment remedies, and related platform services.

Platform Role

South Florida HVAC Help is an advertising-management, call-tracking, call-delivery, and contractor software platform. We help connect homeowners, businesses, property managers, facility representatives, and other customers who need HVAC help with independent HVAC contractors serving South Florida. We are not an HVAC contractor and do not perform HVAC repairs, installations, maintenance, estimates, warranties, or emergency services directly.

Contractor Accounts and Business Information

A contractor may create an account and provide business information such as company name, contact details, service areas, license information, website, the dispatch number that should receive tracked calls, and whether the contractor wants Residential, Commercial, or Residential + Commercial emergency-repair call targeting. Creating an account or configuring a campaign does not by itself publish an advertisement.

We may suspend or terminate accounts for fraud, misuse, security concerns, legal or regulatory risk, nonpayment, unauthorized access, abusive or knowingly false payment disputes, inaccurate business information, or violation of these terms.

Automated Emergency-Repair Advertising Campaigns

South Florida HVAC Help is designed primarily to automate Google Search advertising focused on high-intent AC and HVAC repair and emergency-repair demand in Miami-Dade, Broward, and Palm Beach County. Contractors may select Residential, Commercial, or Residential + Commercial call targeting together with supported county targeting, and the platform may use advertising-platform data, campaign rules, keyword planning, negative keywords, call tracking, and automated controls to create, monitor, pause, resume, and administer campaigns through connected advertising platforms.

Residential targeting may prioritize urgent repair demand from homes, condos, and townhomes. Commercial targeting may prioritize urgent repair demand from businesses, warehouses, offices, retail locations, restaurants, facilities, multifamily or condominium common areas, rooftop systems, and other commercial properties. Commercial targeting is an emergency-repair advertising lane; it does not represent or guarantee maintenance contracts, property-management agreements, construction bids, RFP opportunities, capital projects, installation projects, or other long-cycle commercial work.

The platform may prioritize repair and emergency-search intent such as AC not cooling, broken AC, urgent AC repair, emergency HVAC repair, commercial HVAC repair, and similar service needs. A repair inquiry may later result in replacement work, but the platform does not guarantee any particular service type, property type, call volume, booked job, replacement opportunity, commercial contract, project, or revenue outcome.

Campaigns may require platform review, advertising-platform review, identity verification, ad-account access, active call tracking, compliant destination content, sufficient campaign funding, and compliance with advertising policies. A campaign may remain pending, fail to publish, be rejected, or be paused by the advertising platform. We may pause or decline a campaign that appears unlawful, misleading, unsafe, noncompliant, technically invalid, or likely to create material risk.

The contractor is responsible for the truthfulness and legality of business claims, licenses, offers, pricing statements, warranties, trademarks, testimonials, and destination content supplied or approved for the campaign.

Platform Subscription, Processing Fees, and Campaign Wallet

The current platform subscription is $499 per month. A separately disclosed $18.95 monthly processing fee is charged with the platform subscription, producing a current recurring checkout total of $517.95. The processing fee is separate from the platform subscription price and may be changed prospectively with notice before a future checkout or renewal where permitted by law.

Campaign-wallet funding is separate from the platform subscription and is restricted to advertising. The current wallet processing fee is 3% of the selected wallet amount and is displayed separately before payment. A $500 wallet therefore produces a $515 wallet-funding checkout: $500 restricted to advertising plus a $15 processing fee. The current commercial model charges 0% ad-spend management fee.

Processing fees are retained by South Florida HVAC Help as separate fee revenue and do not increase the restricted Google Ads wallet principal. The campaign funding checkout displays the wallet principal, processing fee, and total charge before payment. The minimum campaign-wallet deposit is displayed in the contractor portal and may be changed prospectively with notice before checkout.

The contractor authorizes the platform to use funded campaign-wallet value for the connected advertising campaign. Advertising spend is recorded from the advertising platform when available and may be delayed, adjusted, rounded, or restated by that platform. The system may automatically pause a campaign when recorded spend reaches available funded media budget or when continued spending would create an unfunded balance.

Funding a campaign does not guarantee immediate publication or delivery. Advertising activation remains subject to subscription, settlement, ad-platform authorization, targeting, call-routing, policy, and preflight checks. Advertising spend already incurred and payment-processing costs already incurred are not refundable and are not eligible for restoration as platform credits except where required by applicable law.

If the platform subscription is canceled or otherwise becomes inactive, campaign advertising may be paused when the paid subscription period ends or when the account becomes ineligible. Unused campaign-wallet principal remains recorded as restricted advertising value on the contractor account; it is not forfeited solely because the membership ended and is not automatically returned as cash. If the contractor later reactivates an eligible platform subscription, the remaining wallet balance may be used for future eligible campaign activity after the normal advertising, call-routing, account, and activation checks are satisfied. Any refund, reversal, or credit request remains governed by the payment-remedy terms below and applicable law.

Final Sale; No Cash Refunds; Credit-Only Remedy

ALL PAYMENTS ARE FINAL. Platform subscriptions, processing fees, campaign-wallet deposits, advertising funding, lead purchases, and other digital services are not refundable to the original payment method, except where a cash refund is required by applicable law or for a verified unauthorized charge. If South Florida HVAC Help approves a billing or service correction, the sole business remedy is a non-cash platform credit.

This policy applies to platform subscription charges, processing fees, renewals, campaign-wallet deposits, advertising funding, legacy marketplace plans, legacy marketplace call purchases, used credits, digital call delivery, and other paid digital services. Cancellation stops future renewals only. It does not reverse a completed charge and does not create a prorated refund for the current billing period.

When South Florida HVAC Help verifies a duplicate platform charge, documented platform delivery error, eligible call-quality issue under a separately published claim policy, or another correctable service issue, South Florida HVAC Help may issue platform credits in its sole reasonable discretion. Platform credits are not cash, have no cash-redemption value, are not a refund to the original payment method, and may be used only for eligible services shown in the portal.

Unused campaign-wallet value approved for a business remedy may be converted to platform credits rather than returned as cash. Amounts already spent with an advertising platform, payment-provider costs, dispute fees, and other amounts already earned or incurred are not creditable except where required by applicable law.

The no-cash-refund and credit-only provisions do not apply where a cash refund is required by applicable law or to a verified unauthorized charge. Policy version: 2026-08-20-processing-fees-v3.

Call Tracking, Recording, and Direct Delivery

The platform may assign a tracking number to a contractor campaign and route inbound calls to the contractor dispatch number. Call status, duration, routing information, attribution data, and recordings may be processed when enabled for quality, reporting, attribution, fraud prevention, and platform operations, subject to applicable law and the disclosures presented during the call.

The contractor is responsible for answering routed calls, maintaining an accurate dispatch number, complying with applicable call-recording and communications laws, and using caller information only for the related HVAC service request.

County and Call-Market Targeting

Contractors may select supported county-level service areas, including Miami-Dade, Broward, and Palm Beach, together with a Residential, Commercial, or Residential + Commercial emergency-repair call-market preference. A county selection may make a campaign eligible for relevant searches from different cities, neighborhoods, and ZIP codes located within that county. Selecting a county or call-market preference does not guarantee impressions or calls from every city, neighborhood, ZIP code, property type, search, business category, or customer type within that selection.

Advertising platforms determine final auction eligibility and delivery based on factors including location signals, search intent, bid, budget, competition, policy, quality, account status, and other platform systems outside South Florida HVAC Help’s control. Search-intent targeting can reduce irrelevant traffic but cannot guarantee that every caller accurately matches a selected residential or commercial category.

No Guarantee of Calls or Business Results

Advertising performance is uncertain. We do not guarantee impressions, clicks, call volume, call quality, residential or commercial classification, caller response, exclusivity, contactability, appointments, estimates, jobs, contracts, projects, revenue, return on ad spend, cost per call, or any other commercial outcome.

A caller may provide inaccurate information, fail to answer later, cancel, choose another contractor, decline service, or contact more than one company. Advertising platforms may limit delivery, reject assets, change attribution, delay reporting, or spend differently than expected. These outcomes do not by themselves establish a platform error or right to a cash refund or platform credit.

Campaign Pausing, Resuming, and Termination

Contractors may use available portal controls to request a pause or resume. Advertising-platform status changes may not be instantaneous. The platform may automatically pause campaigns for exhausted funding, payment problems, compliance concerns, technical errors, security risks, account restrictions, or platform-policy changes.

A paused campaign may continue to show delayed spend, delayed calls, or reporting updates associated with activity that occurred before the pause was fully processed. Termination of an account may disable campaign controls and access to future calls while preserving records required for legal, accounting, security, support, and dispute purposes.

Legacy and Optional Marketplace Services

Older or optional marketplace features may remain present in historical records or limited product areas. Those features are separate from the current $499 platform subscription and Google Search campaign-wallet model. Legacy transactions remain governed by the disclosures, prices, and terms accepted at the time of the transaction and are not retroactively repriced by the current commercial model.

Payment Processing, Billing Concerns, and Chargebacks

Payment information is processed by third-party payment providers. We do not store complete card numbers. Separately disclosed processing fees are platform charges intended to offset payment-processing and related billing costs; they are not taxes and are not part of the restricted Google Ads wallet. Contractors agree to contact support promptly and provide a reasonable opportunity to investigate any billing, campaign, spend, or call-delivery issue before initiating a payment dispute, unless immediate notice to the issuing bank is reasonably necessary to protect a non-waivable right or report an unauthorized charge.

A chargeback or payment dispute does not itself cancel a valid debt, create a refund right, or convert a final sale into a refundable transaction. We may suspend paid services, campaign activity, access to newly delivered information, or future purchasing while a payment dispute is pending. A knowingly false, misleading, duplicative, or abusive dispute is a material breach and may result in account termination and recovery of amounts and actual fees where permitted by law.

We may provide payment processors, card networks, or issuing banks with relevant authorization and fulfillment evidence, including accepted policy versions and exact disclosure text, account records, campaign configuration, funding records, advertising identifiers, spend records, call-delivery records, subscription details, credit ledgers, timestamps, email events, hashed technical evidence, and related communications.

Nothing in these terms prohibits a good-faith report of an unauthorized charge or eliminates any cardholder, consumer, statutory, or other legal right that cannot lawfully be waived by contract.

Residential and Commercial Service Requests and Consent

A homeowner, business representative, property manager, facility representative, or other caller who contacts a tracking number or submits a request authorizes South Florida HVAC Help and the participating independent HVAC contractor to respond regarding that HVAC service need, subject to the disclosures presented and applicable law. Contact does not guarantee contractor availability, a response, an estimate, an appointment, service, a commercial contract, or a project award.

This platform is not a 911 or emergency dispatch service. For a life-safety emergency, contact emergency services immediately.

Independent Contractor Responsibility

All HVAC work is performed by independent contractors. Contractors are solely responsible for licensing, insurance, estimates, permits, workmanship, warranties, scheduling, communications, taxes, employment practices, advertising claims, and compliance with applicable laws and industry requirements.

Any HVAC service agreement, maintenance agreement, project agreement, or other work arrangement is between the customer and the contractor. South Florida HVAC Help does not endorse or warrant a contractor’s work and is not responsible for property damage, personal injury, pricing disputes, service delays, warranties, contract terms, project performance, or other consequences of contractor performance.

Acceptable Use and Security

Users must provide accurate information, use the platform lawfully, protect account credentials, and avoid conduct that disrupts systems or harms other users. Unauthorized access, false service requests, fraudulent campaigns, misleading advertising, credential sharing, payment evasion, data scraping, and misuse of caller information are prohibited.

  • Residential and commercial service requests and calls must reflect a genuine service need.
  • Contractor targeting and advertising claims must be accurate and lawful.
  • Caller and customer information may be used only for the related service request.
  • Users may not circumvent funding, campaign, subscription, attribution, or access controls.
  • Fraudulent disputes, account manipulation, or misuse of delivered data may result in suspension or termination.

Limitation of Liability

To the maximum extent permitted by law, South Florida HVAC Help is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from platform use, advertising-platform actions, campaign performance, contractor conduct, caller behavior, call outcomes, lost profits, or inability to access campaigns or inventory. To the maximum extent permitted by law, aggregate liability is limited to the amount paid to South Florida HVAC Help during the three months preceding the event giving rise to the claim.

Changes and Contact

We may update these terms and policy versions. Material campaign, funding, subscription, processing-fee, or product changes may require a new acknowledgment. Continued use after an effective update constitutes acceptance where permitted by law.
